SUMMARY

On December 15, 2015, the City Council adopted Ordinance No. 3358.  This ordinance amended Chapter 10.52, Stopping, Standing and Parking, of the Chula Vista Municipal Code, by adding Section 10.52.495 (Attachment #1).  This section prohibits parking recreational vehicles on City streets except by permit.  In accordance with the ordinance, staff recommends establishing a recreational vehicle parking permit fee of $2.00 per permit.

The Director of Development Services has reviewed the proposed activity for compliance with the California Environmental Quality Act (CEQA) and has determined that the activity is not a “Project” as defined under Section 15378 of the State CEQA Guidelines because it will not result in a physical change in the environment; therefore, pursuant to Section 15060(c)(3) of the State CEQA Guidelines, the activity is not subject to CEQA.  Thus, no environmental review is required.

 

DISCUSSION

City staff is in the process of implementing an ordinance that prohibits recreational vehicle parking on City streets except by permit.  Chula Vista residents may purchase a recreational vehicle parking permit in order to park their recreational vehicle on the streets near their residence. Each permit shall not exceed 24 hours. Permits will be limited to 72 permits per residence per year and can only be issued for a maximum of three consecutive days.  Chula Vista residents may also purchase a permit for guests with recreational vehicles. The City is currently conducting public outreach by providing information about the new law and will begin enforcement starting in mid-May 2016.

 

Residents will be able to buy a recreational parking permit beginning on May 2, 2016 online through the City’s website or at the Finance Department counter. Proof of residency and vehicle ownership or control is required by the ordinance. 

 

Staff estimates that reviewing each recreational vehicle permit application and issuing a permit will take Finance staff approximately 5 minutes per permit.  Based on a fully burdened hourly rate of $63.71 this would result in a permit cost of approximately $5.30.  However, staff recommends setting the fee for the recreational vehicle parking permit at $2.00 per 24-hour permit in order to encourage compliance with the program.   

 

Staff recommends that the City Council establish the recreational parking permit fee as outlined in this report and attached resolution.

 

DECISION-MAKER CONFLICT

Staff has reviewed the decision contemplated by this action and has determined that it is not site-specific and consequently, the 500-foot rule found in California Code of Regulations Title 2, section 18702.2(a)(11), is not applicable to this decision for purposes of determining a disqualifying real property-related financial conflict of interest under the Political Reform Act (Cal. Gov't Code § 87100, et seq.).

 

Staff is not independently aware, and has not been informed by any council member, of any other fact that may constitute a basis for a decision maker conflict of interest in this matter.

The City's Strategic Plan has five major goals: Operational Excellence, Economic Vitality, Healthy Community, Strong and Secure Neighborhoods and a Connected Community.  This action item supports the Strong and Secure Neighborhood strategy identified in the City's Strategic Plan. 

 

CURRENT YEAR FISCAL IMPACT

In order to encourage compliance with the ordinance, staff recommends that the recreational parking permit fee not be set at the full cost recovery rate. The fiscal impact of this reduction is unknown and will vary depending on the actual number of permits issued and the actual amount of time it takes to issue permits. 

 

ONGOING FISCAL IMPACT

As stated above, the fiscal impact of this program is unknown at this time.  Once this program is fully implemented staff will reevaluate the program costs and determine if a fee change is needed.
