SUMMARY

Resolution 2016-086 authorized emergency spending with Downstream Services Inc., Arrieta Construction Inc., Nu-Line Technologies  LLC, TC Construction Company Inc., SanCon Engineering Inc. and Southwest Pipeline and Trenchless Corp. for CIP DR204, “Storm Drain Repairs at Various Locations “ project in a cumulative amount not-to-exceed $3,000,000. The emergency repairs were completed in November, 2016.  Chula Vista Municipal Code 2.56.100 (A) requires that a full explanation of emergency spending be entered in the minutes of the Council. This report presents the purpose, repair details and total expenditures for the repairs.

The Development Services Director has reviewed the proposed project for compliance with the California Environmental Quality Act (CEQA) and has determined that the project, which consists of removing debris and blockages, spot repairs, and lining of existing CMP storm drain pipes at various locations,  qualifies for a Class 1 Categorical Exemption pursuant to Section 15301 (Existing Facilities) of the State CEQA Guidelines because it involves negligible or no expansion of an existing use, and all work will be done within existing City of Chula Vista right-of-way. Thus, no further environmental review is necessary.

DISCUSSION

Due to the strong El Nino event that was expected last winter, failures in the Corrugated Metal Pipe (CMP) were anticipated to occur.  Such failures could have resulted in damage to public and private property and jeopardized the health, safety and general welfare of the community.  Because of the imminent nature of the threats involved, on November 6, 2015, the Director of Public Works issued an informational memo notifying the Mayor and City Council that staff was preparing construction contracts to address the potential CMP failures and the work would be procured in accordance with the emergency provisions contained in Section 1009 of the City Charter.  Since then, staff proceeded with obtaining bids from qualified local contractors and the emergency repairs to the failing CMP storm drain pipes.  Funding comes from two existing drainage repair projects (DR202 and DR204, $1.9M); reallocating the funds from Cross Gutter Rehabilitation (STL408, $347k); and Pavement Minor Rehabilitation Program (STL409, $970k). Replenishing funds for STL408 and STL409 will be reconsidered in the 2016/2017 CIP.  All projects are in the current CIP and funded with Gas Tax and Transnet Funds.

 

Due to the impending wet season, the project strategy was phased to first stabilize the CMP pipe with temporary repairs using concrete allowing the contractors time to procure and install the permanent repairs.  Temporary stabilization was completed around the end of January, 2016.  Permanent repairs started immediately afterwards mostly utilizing trenchless repair strategies with PVC rigid pipe liners or fiberglass cured-in-place pipe liner.  These are nationally recognized pipeline repair methods with independent testing that show a life expectancy of up to 100 years.  Some damaged CMP pipe segments were in such bad shape that trenchless pipe lining techniques could not be used.  In these cases, the CMP pipe was replaced with Reinforced Concrete Pipe (RCP) using standard open trench methods.  All of the smaller damaged pipe segments with readily available pipe liners (up to 36 inch) and all the RCP replacement segments were completed by April, 2016.  The larger size pipes (42 to 54 inch) required significant lead time to manufacture the pipe liner materials.  These larger pipes could not be lined until approximately early summer of 2016. However, these pipes were initially stabilized with concrete at the beginning of the project and would have been able to withstand significant storm events.  All repair work was completed by November, 2016.

       

In accordance with City Charter Section 1009, and based upon the urgent necessity for the preservation of life, health and property, City staff solicited bids and contracted the services of the following responsive bidders;

 

                     TC Construction Company Inc.

                     Downstream Services, Inc.

                     Arrieta Construction, Inc.

                     Nu-Line Technologies LLC

 

All contractors met the City’s Liability Insurance requirements and all work was performed at Prevailing Wage Rates.  All construction work was performed within City right-of-way, under streets and sidewalk.  No work was performed in open channels, sensitive habitat, or wetland areas.

 

The approval of this resolution would: (1) accept the final report of expenditures for  “Emergency Storm Drain Repairs of Corrugated Metal Pipe (CMP) at various locations for CIP DR204”, (2) make a finding that an emergency existed, and (3) ratify the contracts with TC Construction Company Inc., Downstream Services, Inc., Arrieta Construction, Inc., and Nu-Line Technologies LLC for said emergency work.

DECISION-MAKER CONFLICT

Staff has reviewed the property holdings of the City Council and has found no property holdings within 500 feet of the boundaries of the property which is the subject of this action. Consequently, this item does not present a disqualifying real property-related financial conflict of interest under California Code of Regulations Title 2, section 18702.2(a)(11), for purposes of the Political Reform Act (Cal. Gov’t Code §87100,et seq.).

 

Staff is not independently aware, and has not been informed by any City Council member, of any other fact that may constitute a basis for a decision maker conflict of interest in this matter.

CURRENT YEAR FISCAL IMPACT

There is no additional impact to the TransNet Fund as there are sufficient funds in CIP DR204 necessary to fund the project.  A summary of the project costs is as follows:
