SUMMARY

SLF IV-Millenia, LLC (Millenia) is currently moving forward with Phase 1 of the Millenia project (formerly the Eastern Urban Center). Phase 1 includes the construction of two turn-key public urban parks:  Park P-1, called Stylus Park, located at the northeast quadrant and Park P-4, called Strata Park, located at the southeast quadrant of the project.  Stylus Park is currently under construction with completion of construction anticipated in the first quarter of this year.

 

This item requests City Council approval of a Three-Party Agreement for Landscape Architecture Services for the design of Park P-4 which is the second of six planned parks to be designed and built within the Millenia project.

The design of future parks in the project will be the subject of a separate Three-Party Agreement.

DISCUSSION

Background

On September 15, 2009, in accordance with City Council Resolution 2009-226, the City approved the Eastern Urban Center Parks Agreement (Parks Agreement) between Millenia and the City for the construction of parks in a portion of the Otay Ranch Eastern Urban Center.  The Parks Agreement includes thresholds for the completion of the Millenia Parks and establishes the parameters for the design, development, and delivery of parks and recreation facilities for Millenia, including provisions for preparing park master plans and park construction documents. 

 

In accordance with the adopted Sectional Planning Area (SPA) Plan, the six Millenia parks are located for convenient and quick pedestrian access by residents in the surrounding districts, and the parks’ conceptual designs stem from the idea that Millenia is a place of energy, with each park exploring notions of kinetic energy (active use) and potential energy (passive use), with the park designs presenting variations on a theme of energy types, characteristics, or utilization. 

 

Strata Park is 1.51 acres and is to be located at the intersection of Strata Street and Orion Avenue which is surrounded by residential uses (Attachment 1). In accordance with the Conceptual Park Design in the EUC SPA Plan, the Park’s energy theme is “Cycles” and is intended to reflect the cyclical and transformative aspects of energy.  Representative facilities and uses include children’s play area, interpretive displays, various gardens, a dog park, a central plaza, among others (Attachment 2).  The Regional Trail, a major pedestrian route, passes through Strata Park connecting the visitors to destinations throughout the Millenia community and beyond.

 

Strata Park will be publicly owned and maintained to City standards or as may further be defined within the Park Master Plan.  In accordance with the Parks Agreement, the City and Millenia are to split equally (50% City and 50% Community Facility District) the costs of maintaining this public park.  This financing structure has been put into place with the Council’s approval of Community Facilities District 14M.

 

The design and approval of the Park Master Plan and Construction Documents will be managed by Millenia with the City reviewing and approving all park documents in accordance with the Parks Agreement and the City’s Landscape Manual to ensure the park satisfies all applicable City standards and requirements for both design and maintenance.

Consultant Services Selection Process

Millenia issued a RFQ/RFP on August 10, 2015 for a development of a Park Master Plan and Construction Documents. The document was publicly noticed in accordance with the City’s bidding procedures.

A total of eight firms responded by 4 p.m. on September 26, 2015 (due date).   A panel comprised of representatives of Millenia and the City interviewed five of the eight firms and based on pre-determined criteria, selected MIG, Inc. (Consultant) as the preferred consultant. Three firms were eliminated from consideration prior to the interviews based on factors related to cost and responsiveness to the RFQ/RFP.

Scope of Work

The scope of work includes the preparation of a Park Master Plan, Construction Documents, and construction administration.  The approved Design Project Schedule anticipates the work taking approximately fourteen months.  Construction of the park shall be via a separate contract.

 

1.                     Master Plan

 

A Preliminary Master Plan is to be prepared by the Consultant in accordance with the City’s Landscape Manual to refine the concept plan for Strata Park which is included in the adopted Millenia SPA Plan.  The Preliminary Master Plan is to include the development of a site plan for consideration and approval by both Millenia and the City. 

 

Subsequently, the Preliminary Master Plan is to be refined to develop a Draft Master Plan to be presented to the Parks and Recreation Commission and the City Council for review and approval.

 

 2.  Construction Documents

 

This phase consists of the preparation, review and approval of all plans necessary for bid purpose and for utilization by the contractor for the installation of the park.  Construction documents are to be prepared by the Consultant in accordance with the requirements of applicable City codes, the Uniform Building Code, the City of Chula Vista Landscape Manual, and other pertinent park development standards and specifications.  

 

3.   Construction Administration

 

The Consultant is to provide professional Landscape Architectural Services as required to represent Millenia’s and the City’s interest during construction of the park improvements.  The Consultant is to meet with the construction contractor to ensure the design intent of the drawings is interpreted accurately.  Preparation of As-Built plans is included in this effort.

 

Contract Payment

 

The total cost of the contract for consulting services is $251,240 with an additional $18,290 for a contract administration services during construction.  Millenia will pay all Consultant costs under a separate contract with MIG, as well as, will reimburse the City for all associated staffing costs through the projects’ deposit accounts.

 

DECISION-MAKER CONFLICT

Staff has reviewed the property holdings of the City Council members and has found no property holdings within 500 feet of the boundaries of the property which is the subject of this action. Consequently, this item does not present a disqualifying real property-related financial conflict of interest under California Code of Regulations Title 2, section 18702.2(a)(11), for purposes of the Political Reform Act (Cal. Gov’t Code §87100,et seq.).

 

Staff is not independently aware, and has not been informed by any City Council member, of any other fact that may constitute a basis for a decision maker conflict of interest in this matter.

 

LINK TO STRATEGIC GOALS

The City’s Strategic Plan has five major goals: Operational Excellence, Economic Vitality, Healthy Community, Strong and Secure Neighborhoods and a Connected Community. 

The Three-Party Agreement defines the relationship between MIG, Millenia and the City and forms a collaborative team to create a Park that will transform the southeastern neighborhood into a thriving and safe destination with strong connections to the surrounding communities while providing active and passive recreation for residents.

CURRENT YEAR FISCAL IMPACT

There will be no impact to the General Fund for consulting services.  Millenia will fully compensate the Consultant for services provided, and will also reimburse the City for all associated staffing costs through the projects’ deposit accounts.

 

ONGOING FISCAL IMPACT

Approval of the Three-Party Agreement will not result in on-going fiscal impacts since the Millenia is solely responsible for compensating the Consultant and reimbursing the City for all associated staffing costs.  Also, production of the Strata Park design under contract is a one-time work effort that is expected to be completed by end of 2016.
