SUMMARY
On May 6, 2015, the Director of Public Works received six (6) sealed bids for the "Cross Gutter Rehabilitation Citywide FY2014-2015 (CIP#STL403)" project.  The project will remove and replace cross gutters that are in disrepair on various City streets as listed in the Attachment1.  An appropriation is required from the Gas Tax to adequately fund the project.
 
ENVIRONMENTAL REVIEW
The Development Services Director has reviewed the proposed project for compliance with the California Environmental Quality Act (CEQA) and has determined that the project qualifies for a Class 1(c) categorical exemption pursuant to Section 15301 (Existing Facilities) of the State CEQA Guidelines. Thus, no further environmental review is necessary.

DISCUSSION
This project is included in the FY2014/2015 Capital Improvement program budget to rehabilitate existing cross gutters that are in disrepair at various locations within the City.  Engineering staff prepared the contract documents and advertised the project on April 17, 2015.
 
On May 6, 2015, the Director of Public Works received six (6) sealed bids.  The following bids were received:

*The submitted bid proposal contained mathematical errors that did not affect the unit price, but affected the total bid amount.  Corrections of bid totals did not change the outcome and ranking of the bids.
 
The low bid submitted by Carolino and Son Engineering Corporation is above the Engineer's estimate of $155,832 by $21,945 (approximately 12%).  The higher than estimated bid amounts are due to mandatory Prevailing Wage rate requirements of all new Public Works Contracts.
 
Carolino and Son Engineering Corporation is currently an active licensed Class "A," General Engineering Contractor (License No. 833149) and have performed similar work in the City with satisfactory performance.  Staff has reviewed Carolino and Son Engineering Corporation's bid and determined it to be responsive.
 
Therefore, staff recommends awarding the STL403 project contract to Carolino and Son Engineering Corporation.
 
Wage Statement
The contractor and its subcontractors are required by bid specifications to pay prevailing wage ("Prevailing Wage Rates") to persons employed by them for work under this Contract.  In accordance with the provisions of Section 1773 of the Labor code of the State of California, the City of Chula Vista has ascertained the general prevailing wage scales applicable to the work to be done.  The prevailing wage scales are those determined by the Director of Industrial Relations, State of California.

Attachment 2 is a copy of the Contractor's Disclosure Statement.
 
DECISION-MAKER CONFLICT
Staff has reviewed the decision contemplated by this action and has determined that the decision solely concerns repairs, replacement or maintenance of existing streets, water, sewer, storm drainage or similar facilities. Consequently, pursuant to California Code of Regulations Title 2, sections 18700 and 18705.2(c), this item does not present a real property-related conflict of interest under the Political Reform Act (Cal. Gov't Code § 87100, et seq.).
 
Staff is not independently aware, and has not been informed by any City Council member, of any other fact that may constitute a basis for a decision maker conflict of interest in this matter.
 
LINK TO STRATEGIC GOALS
The City's Strategic Plan has five major goals: Operational Excellence, Economic Vitality, Healthy Community, Strong and Secure Neighborhoods and a Connected Community.  The "Cross Gutter Rehabilitation Citywide FY2014-2015 (CIP#STL403) project supports the Strong and Secure Neighborhoods Strategic Goal as it will both rehabilitate and improve the design of cross gutters to ensure proper drainage of city streets and also improve vehicle drivability.
 
CURRENT YEAR FISCAL IMPACT
Approval of this resolution will result in the appropriation of $45,000 in Gas Tax funds to STL403 project for City Staff costs.  There are sufficient Gas Tax funds available for this appropriation.
 
Under City Council Policy No.574-01, "the Director of Public Works is hereby delegated limited authority to approve change orders for work being done under City public works contracts."  The maximum aggregate contract increase that may be approved by the Director of Public Works for the STL403 project is $22,444.  This amount is equal to the contract contingency costs shown below.
