Staff is requesting authorization to submit a regional used oil payment program application on behalf of Chula Vista as the lead agency for the participating jurisdictions of Coronado, El Cajon, Imperial Beach, La Mesa, Lemon Grove, National City, and Santee. In addition, staff is requesting this resolution be effective for a period of five (5) years from the date of adoption.

The Director of Development Services has reviewed the proposed activity for compliance with the California Environmental Quality Act (CEQA) and has determined that the activity is not a “Project” as defined under Section 15378 of the State CEQA Guidelines because it will not result in a physical change in the environment; therefore, pursuant to Section 15060(c)(3) of the State CEQA Guidelines, the activity is not subject to CEQA.  Thus, no environmental review is required.

 

BOARD/COMMISSION RECOMMENDATION

The Resource Conservation Commission recommends City Council approve the resolution.

 

DISCUSSION

The California Oil Recycling Enhancement Act (Act), which is administered by the California Natural Resources Agency - Department of Resources Recycling and Recovery (CalRecycle), is a law designed to discourage the illegal disposal of used lubricating oils. In September 2009, Governor Schwarzenegger signed Senate Bill 546 (Lowenthal) (SB 546), making significant changes to the Act.

The Act provides funds to cities and counties for establishing and maintaining a local used oil recycling program. The primary purpose of the funds are to provide alternatives to illegal disposal of used motor oil (and other lubricating oils) through a network of collection opportunities and outreach efforts designed to inform and motivate the public to recycle used oil and oil filters as well as use re-refined oil in their vehicles and equipment.

The most significant changes to the used oil recycling program include:

                     Increased fee paid by manufacturers, from $0.16 per gallon to $0.26 per gallon, which increases the funding available to cities and counties to operate their used oil recycling programs.

                     Available funding to cities and counties is $0.27 per capita, paid every two (2) years.

                     The Act replaced the traditional used oil grant program with the used oil payment program. Funds will be received in advance of the expenditures and must be spent on program activities within 18 months of receipt. Jurisdictions will no longer be required to front the money and invoice the state for the expenditures.

Staff has successfully administered a used oil program for the cities of Chula Vista, Imperial Beach, and National City since 1993. Chula Vista became the lead agency for the cities of Coronado, El Cajon, La Mesa, Lemon Grove, and Santee once the used oil payment program was established in 2010.

With used oil payment program funds, staff educates the public regarding the proper disposal of used oil and oil filters via printed materials and other mediums such as television and radio, and offers residents convenient services such as curbside pick-up of used oil and oil filters. Staff also purchases functional items associated with oil changes, such as drain pans, shop towels, and filter wrenches and holds special events like oil filter exchanges during which the public can exchange used oil filters for new filters at no charge.

In 2010, the Chula Vista Council approved a revised resolution (Resolution no. 2010-167) authorizing the submittal of a regional used oil payment program application on behalf of Chula Vista as the lead agency for the cities of Coronado, El Cajon, Imperial Beach, La Mesa, Lemon Grove, National City, and Santee. Resolution no. 2010-167 was effective for five (5) years from the date of adoption on June 22, 2010.

Staff is requesting authorization to submit a regional used oil payment program application on behalf of Chula Vista as the lead agency for the aforementioned cities. The City Manager or designee is authorized to execute on behalf of the City of Chula Vista all documents and amendments necessary to secure funding under the Used Oil Payment Program. In addition, staff is requesting this resolution be effective for a period of five (5) years from the date of adoption.

 

DECISION-MAKER CONFLICT

Staff has reviewed the decision contemplated by this action and has determined that it is not site-specific and consequently, the 500-foot rule found in California Code of Regulations Title 2, section 18702.2(a)(11), is not applicable to this decision for purposes of determining a disqualifying real property-related financial conflict of interest under the Political Reform Act (Cal. Gov't Code § 87100, et seq.).

Staff is not independently aware, and has not been informed by any Council member, of any other fact that may constitute a basis for a decision maker conflict of interest in this matter.

 

LINK TO STRATEGIC GOALS

The South Bay/East County Regional Used Oil Recycling Program supports the City’s Healthy Community goal by providing free used motor oil and filter recycling opportunities throughout the South Bay and East County watershed region of San Diego County and is funded by the State of California’s Oil Recycling Enhancement Act. Pollution knows no boundaries, and for this reason, proper handling of used motor oil and filters upstream ensures that Chula Vista’s waterways and bay front will not be the downstream recipient of these pollutants due to improper disposal.

 

CURRENT YEAR FISCAL IMPACT

There is no current fiscal year impact. The Oil Payment Program is cash grant program. Funds are received in advance and are appropriated through the budget process.

 

ONGOING FISCAL IMPACT

There will be no ongoing fiscal impact to the General Fund.
