SUMMARY

In 2012, the City entered into a Memorandum of Understanding (MOU) with the Center for Employment Opportunities to support Public Works maintenance crews with CEO crews of individuals paroled from our local prison system that are striving to re-enter the workforce. The MOU initially expired November 2013 and was extended to June 2016. Staff recommends Council approval to enter into a new one-year agreement with CEO, with three one-year options by mutual agreement of CEO and City if work performance is satisfactory.

The Director of Development Services has reviewed the proposed activity for compliance with the California Environmental Quality Act (CEQA) and has determined that the activity is not a “Project” as defined under Section 15378 of the State CEQA Guidelines because it will not result in a physical change in the environment; therefore, pursuant to Section 15060(c)(3) of the State CEQA Guidelines, the activity is not subject to CEQA.  Thus, no environmental review is required.

DISCUSSION

In 2012, the City entered in a two-year Memorandum of Understanding (MOU) with the Center for Employment Opportunities (CEO) to support Public Works maintenance crews with CEO crews of individuals paroled from our local prison system that are striving to re-enter the workforce. This non-profit organization, CEO, provides a supervised full time eight-person work crew. The program provides valuable transitional work experience for the participants and studies have demonstrated that individuals with a criminal history who gain employment are less likely to re-offend.

 

For a $75,000 annual compensation by the City, CEO work crews will provide services to the Parks Sections for various maintenance projects including landscape maintenance, graffiti removal, and painting. Furthermore, CEO will provide brush clearance, trail maintenance, revegetation, and weed abatement services support to various Open Space Districts, for which the costs will be reimbursed from those Districts. CEO will also provide landscape maintenance and other services as needed to the Otay Valley Regional Park (OVRP).

 

Additionally, the City has agreed to make a one-time $10,000 payment to CEO, during the period July 1, 2016 to June 30, 2017, to support the purchase of tools and equipment for use in the City by CEO work crews, with the following provisions: (a) The City shall not accede to any future CEO requests to purchase, repair, or replace work tools and equipment; (b) CEO shall be responsible for training its work crews in the safe use, maintenance, and storage of the tools and equipment; and (c) The City shall not be liable for any bodily injury, personal injury, or property damage arising from the handling and use of the tools and equipment. 

 

DECISION-MAKER CONFLICT

Staff has reviewed the decision contemplated by this action and has determined that it is not site-specific and consequently, the 500-foot rule found in California Code of Regulations section 18704.2(a)(1), is not applicable to this decision. Staff is not independently aware, and has not been informed by any Council member, of any other fact that may constitute a basis for a decision maker conflict of interest in this matter.

 

LINK TO STRATEGIC GOALS

The City’s Strategic Plan has five major goals: Operational Excellence, Economic Vitality, Healthy Community, Strong and Secure Neighborhoods and a Connected Community. The Third Amendment to the CEO MOU supports the following Strategic Goals: Operational Excellence - CEO work crews provide support for various maintenance projects such as outdoor maintenance, cleaning, beautification, and grounds keeping. Healthy Community - maintaining community open space for public enjoyment

 

CURRENT YEAR FISCAL IMPACT

No additional appropriations are being requested for Fiscal Year 2015-16.

 

 

ONGOING FISCAL IMPACT

The Fiscal Year 2016-17 budget includes an appropriation of $25,000 from the Open Space Districts and $50,000 from the Public Works Operations budget for CEO-provided maintenance services. An additional $10,000 one-time payment to CEO, during Fiscal Year 2016/2017, for the purchase of tools and equipment will be appropriated from Open Space Districts ($5,000) and Public Works Operations budget ($5,000) respectively. Future maintenance services from CEO are subject to the annual budget process.
