SUMMARY
On September 13, 2011, in accordance with Resolution 2011-178, the City Council awarded a contract to Golden Bell Products, Inc. (Golden Bell) for providing sewer collection systems vermin eradication services for Fiscal Years (FY) 2012-16. Since then, the vermin eradication program has been successful in controlling the spread of roaches. After advertising a new RFP and screening proposals, staff is recommending that the City enter into an agreement with Golden Bell to provide vermin eradication services for FY 2017-21.

The Director of Development Services has reviewed the proposed project for compliance with the California Environmental Quality Act (CEQA) and has determined that the project qualifies for a Class 1 Categorical Exemption pursuant to Section 15301 (Existing Facilities) of the State CEQA Guidelines. Thus, no further environmental review is required.

DISCUSSION
Over the course of time, the City sewer manholes in certain areas of the City have been inhabited with roaches. Roaches multiply due to the moist environment in the sewer collection system. Controlling the spread of roaches reduces the health threat to both maintenance crews and the general public.
On September 13, 2011, by Resolution 2011-178 (Attachment 1), City Council awarded a contract to Golden Bell to provide sewer collection systems vermin eradication services for FY 2012-16. During this time, the vermin eradication program has been able to control the spread of roaches.
Since the current contract with Golden Bell expired on June 30, 2016, staff issued a Request for Proposals on April 27, 2016, in order to select a contractor able to provide Sewer Collection Systems Vermin Eradication Services for FY 2017-21. Subsequently, on May 11, 2016, the Director of Public Works received three (3) proposals for this project with the following bids:

Eagleshield and Cartwright requested almost two times and nineteen times the cost of Golden Bell, respectively. When comparing proposals, Golden Bell is proposing to treat significantly more manholes than either of the other contractors.
The contract amount for this project is $50,000 for FY 2017. The City has the option to extend this contract for an additional four years. Council's approval will allow the City Engineer to enter into an agreement with Golden Bell for vermin eradication services for an amount of $50,000 for FY 2017 and will also authorize the City Engineer to add up to four one-year-extensions to be funded from the sewer operating budget. Extension shall require the mutual agreement of the parties. The maximum contracted amount for each extension is limited to $50,000 per year with an allowable increase of 2% per year in the unit cost as described in the following table:

The number of manholes to be treated shall be based on the unit price submitted by the contactor. The City has the right to terminate this contract at any time without any obligations (Attachment 2).
Consultant Selection Process
On May 16, 2016, upon reviewing the written proposals and based on previous contract with Golden Bell, staff determined that Golden Bell met the qualifications required to provide eradication services based on the following criteria:
1. Company references
2. Company staff experience
3. Capacity to perform work
4. Responsiveness to scope of work
Golden Bell proposes to use Insecta, which is an innovative product to control roaches. Insecta is a patented method of locking chemicals into a non-evaporating latex coating that lasts several times longer than conventional spray applications, giving the product the unique ability to kill roaches for two years.
Since 2011, Golden Bell has been providing vermin eradication services for the City, has proven its expertise in applying Insecta 45600-1, and has warranted that it is experienced and staffed in a manner such that it can deliver the required services required in accordance with the timeframes and the terms and conditions of this Agreement.
DECISION-MAKER CONFLICT
Staff has reviewed the decision contemplated by this action and has determined that it is not site-specific and consequently, the 500-foot rule found in California Code of Regulations Title 2, section 18702.2(a)(11), is not applicable to this decision for purposes of determining a disqualifying real property-related financial conflict of interest under the Political Reform Act (Cal. Gov't Code § 87100, et seq.).
Staff is not independently aware, and has not been informed by any City Council member, of any other fact that may constitute a basis for a decision maker conflict of interest in this matter.

This project supports the operational excellence and economic vitality goals in the City’s strategic plans. It better provides clean and safe environment for the City Public Works Staff and the surrounding neighborhoods.
CURRENT YEAR FISCAL IMPACT
Approval of the Resolution will award a five year agreement to Golden Bell Products, Inc. for providing sewer vermin eradication. Sufficient funds were budgeted in the Sewer Service Operating budget for FY 2016-17.
ONGOING FISCAL IMPACT
The cost for the optional extension not to exceed $50,000 annually for the proceeding four years is anticipated to be budgeted for subsequent years in the sewer operating budget.
