SUMMARY

Accepting this grant will enhance the City's household hazardous waste (HHW) program with the installation of more convenient collection sites for household batteries and single-use gas cylinders, which complements services provided by the Regional Household Hazardous Waste Drop-off Facility at the Public Works Yard, 1800 Maxwell Road.  

 

ENVIRONMENTAL REVIEW

The Development Services Director has reviewed the proposed project for compliance with the California Environmental Quality Act (CEQA) and has determined that the project qualifies for a Class 8 categorical exemption pursuant to Section 15308 (Actions by Regulatory Agencies for Protection of the Environment) of the State CEQA Guidelines because the grant will be used develop a collection system and to place collection containers at various locations and businesses.  Thus, no further environmental review is necessary.  Although environmental review is not necessary at this time, once the location for the collection containers has been determined, environmental review will be required and a CEQA determination completed prior to installing the container.

DISCUSSION

On February 9, 2004, regulations took effect in California that classified discarded fluorescent lamps, electronic devices, household batteries and mercury containing devices as Universal Waste, per State household hazardous waste regulations, and were subsequently banned from disposal in landfills. This left local jurisdictions with the burden of providing special collection of these materials with no or limited funds to do so. Acceptance of this grant will allow staff to offer more convenient disposal locations for household, single-use batteries and one-pound, non-refillable propane cylinders at local retail stores throughout the city.

 

The original grant application was submitted to CalRecycle in 2013, but was rejected as there were many more applicants than available funding.  This year CalRecycle has the funding but not enough applications.  CalRecycle asked Chula Vista to reconsider doing the proposed work for the 2015-2016 grant cycle (work to be completed from October 2015 through March 2018).

 

The original grant was submitted as a partnership with the California Product Stewardship Council (CPSC) and Call2Recycle (the first battery stewardship program in North America). These not-for-profit organizations have agreed to reconstitute the Scope of Work for the new grant cycle. Funds will be utilized to purchase collection receptacles, for program marketing, CPSC staff time and City administrative staff time.

 

DECISION-MAKER CONFLICT

Staff has reviewed the decision contemplated by this action and has determined that it is not site-specific and consequently, the 500-foot rule found in California Code of Regulations Title 2, section 18705.2(a) (11) is not applicable to this decision for the purpose of determining a disqualifying real property-related financial conflict of interest under the Political Reform Act (Cal. Gov’t Code § 87100, et seq.)

 

Staff is not independently aware, and has not been informed by any Council member, of any other fact that may constitute a basis for a decision maker conflict of interest in this matter.

 

LINK TO STRATEGIC GOALS

The City’s Strategic Plan has five major goals: Operational Excellence, Economic Vitality, Healthy Community, Strong and Secure Neighborhoods and a Connected Community. This Household Hazardous Waste Grant Project supports the City’s Healthy Community goal by providing more convenient locations to properly dispose of and recycle household batteries and single-use gas cylinders throughout the City and complements the services provided at the Regional Household Hazardous Waste Drop-off Facility, located at the Public Works Yard, 1800 Maxwell Road, CV, 91911.

 

CURRENT YEAR FISCAL IMPACT

                                          

The CalRecycle Grant will support up to $14,725 of staff time associated with the grant oversite, project planning and implementation, as well as $75,275 for collection equipment and service contracts.  Any additional staff time will be supported by the Environmental Services budget.

 

Approval of the resolution will result in the appropriation of $90,000 to the Waste Management & Recycling Fund; project expenditures will be offset by this grant funding. 

 

ONGOING FISCAL IMPACT

There will be no ongoing fiscal impact to the General Fund as a result of this work. The grant project work is to be completed by March 2018.  Any ongoing work in this area will be supported by the Environmental Services budget.
