SUMMARY

On April 19, 2017, the Director of Public Works received five (5) sealed bids for the Construction Project consisting of ADA Curb Ramps FY2014/2015 (CIP# STL405), ADA Curb Ramps FY2016/2017 (CIP# STL415) and Replacement of Curb and Gutter Program Citywide FY2015/16 (CIP# STL407) in the City of Chula Vista, California Project.  This project will install ADA pedestrian ramps: replace damaged curb, gutter and sidewalk; trim trees and prune roots damaging the sidewalk; all in various locations throughout the city; and construct certain intersection improvements at Third Avenue and Main Street.

The Project qualifies for a Categorical Exemption pursuant to the California Environmental Quality Act State Guidelines Section 15301 Class 1 (Existing Facilities) and/or Section 15304 Class 4 (Minor Alterations to Land).

The Director of Development Services has reviewed the proposed project for compliance with the California Environmental Quality Act (CEQA) and has determined that the project qualifies for a Categorical Exemption pursuant to State CEQA Guidelines Section 15301 Class 1 (Existing Facilities) and/or Section 15304 Class 4 (Minor Alterations to Land). Thus, no further environmental review is required.

DISCUSSION

The project’s scope of work includes the installation of ADA pedestrian ramps where they are missing and replacement of damaged curb, gutter and sidewalk in various locations throughout the City.  The Project also includes tree trimming, root pruning and some tree removal; the replacement of a damaged inlet; and intersection improvements and traffic signal modifications at Third Avenue and Main Street.

 

On April 19, 2017, the Director of Public Works received five (5) bids as follows:

The low bid by Just Construction Inc. of $783,996.00 is $104,296 (approximately 15%) above the Engineer's estimate of $679,700.  

 

Just Construction, Inc. is a currently an active licensed Class “A”- General Engineering Contractor; Class “B”- General Building Contractor and Class “C-8”- Concrete (License No. 968910) and has performed similar work in the City with satisfactory performance. Staff has reviewed the bid submitted by Just Construction, Inc. and has determined it to be responsive. Just Construction, Inc. has provided the City with a letter dated May 24, 2017, stating that the contract amounts in their bid will valid through the end of July 2017 (see Attachment 1).  Therefore, staff recommends awarding the STL405, STL407 and STL415 project contract to Just Construction Inc.

 

Wage Statement

The Contractor and its subcontractors are required by bid specifications to pay prevailing wages (“Prevailing Wage Rates”) to persons employed by them for work under this Contract. In accordance with the provisions of Section 1773 of the Labor Code of the State of California, the City of Chula Vista has ascertained the general prevailing wage scales applicable to the work to be done. The prevailing wage scales are those determined by the Director of Industrial Relations, State of California.

DECISION-MAKER CONFLICT

Staff has reviewed the decision contemplated by this action and has determined that it is not site-specific and consequently, the 500-foot rule found in California Code of Regulations Title 2, section 18702.2(a)(11), is not applicable to this decision for purposes of determining a disqualifying real property-related financial conflict of interest under the Political Reform Act (Cal. Gov't Code § 87100, et seq.).

 

Staff is not independently aware, and has not been informed by any City Council member, of any other fact that may constitute a basis for a decision maker conflict of interest in this matter.

The City’s Strategic Plan has five major goals: Operational Excellence, Economic Vitality, Healthy Community, Strong and Secure Neighborhoods and a Connected Community.  The installation of ADA Pedestrian Ramps and Replacement of Broken Curb, Gutter and Sidewalk supports the Strong and Secure Neighborhoods Strategic Goal as it maintains public infrastructure vital to the quality of life for residents.

 

CURRENT YEAR FISCAL IMPACT

Approval of the resolution will initiate the construction phase of STL405, STL407 & STL415 and appropriate $50,000 in Traffic Signal Funds to STL405 for work at Third Avenue and Main Street, and transfer $150,000 from STL424 to STL405.  Together, with the newly appropriated funds, sufficient TransNet and Gas Tax Funds are available to complete the project.  Therefore, there is no additional impact to these funds.
