SUMMARY

The Police Department has recently received notice of grant funding in the amount of $12,500 from the Department of Alcoholic Beverage Control (ABC).  The goal of this grant is to reduce the availability of alcohol to minors and reduce alcohol-related crime through multiple enforcement, educational and prevention programs conducted by ABC Agents and local law enforcement officers.

 

ENVIRONMENTAL REVIEW

The Development Services Director has reviewed the proposed activity for compliance with the California Environmental Quality Act (CEQA) and has determined that the activity is not a “Project” as defined under Section 15378(b)(5) of the State CEQA Guidelines because it will not result in a physical change in the environment; therefore, pursuant to Section 15060(c)(3) of the State CEQA Guidelines, the activity is not subject to CEQA.  Thus, no environmental review is necessary.

DISCUSSION

The Police Department has been awarded $12,500 from the Department of Alcoholic Beverage Control (ABC).  These grant funds, which cover the 12-month period of October 1, 2015 to September 30, 2016, will mainly be used for Minor Decoy and Shoulder Tap Decoy operations, and Informed Merchants Preventing Alcohol-Related Crime Tendency (IMPACT) inspections, which will be conducted on an overtime basis.  A portion of the grant funding ($1,000) will be used for mandatory ABC training to cover operational and reporting requirements.

 

Minor Decoy operations are compliance checks in which teenagers, under the direct supervision of police officers, attempt to purchase alcohol from retail licensees.  The Shoulder Tap program targets adults who purchase alcohol for minors on or around ABC licensed businesses.  The IMPACT program involves inspections of ABC licensed businesses.

 

In 2014, the City of Chula Vista passed a Responsible Beverage Service ordinance and has hosted ABC-sponsored trainings on a monthly basis with great success.  The partnership with ABC has allowed the Police Department to conduct ABC enforcement strategies and combat underage access to and consumption of alcohol.

 

DECISION-MAKER CONFLICT

Staff has determined that the action contemplated by this item is ministerial, secretarial, manual, or clerical in nature and, as such, does not require the City Council members to make or participate in making a governmental decision, pursuant to California Code of Regulations Title 2, section 18704.4(a)(1). Consequently, this item does not present a conflict under the Political Reform Act (Cal. Gov't Code § 87100, et seq.). Staff is not independently aware, and has not been informed by any City Council member, of any other fact that may constitute a basis for a decision maker conflict of interest in this matter.

 

LINK TO STRATEGIC GOALS

The City’s Strategic Plan has five major goals: Operational Excellence, Economic Vitality, Healthy Community, Strong and Secure Neighborhoods and a Connected Community.  This resolution supports the goal of Strong and Secure Neighborhoods by proactively conducting ABC enforcement operations in the city.

 

CURRENT YEAR FISCAL IMPACT

Approval of this resolution will result in a one-time appropriation of $11,500 to the personnel category and $1,000 to the supplies and services category of the Police Grant Fund.  The funding from the Department of Alcoholic Beverage Control will completely offset these costs, resulting in no net fiscal impact to the General Fund

 

ONGOING FISCAL IMPACT

There is no ongoing fiscal impact for accepting these grant funds.
