SUMMARY

Pursuant to Public Resources Code (PRC) section 14581(a)(3)(A) of the California Beverage Container Recycling and Litter Reduction Act, the Department of Resources Recycling and Recovery (CalRecycle) is distributing $10,500,000 in fiscal year (FY) 2015‒16 to eligible cities and counties specifically for beverage container recycling and litter cleanup activities. Staff is requesting Council approval to apply for this reoccurring annual cash payment program for a period of five years through 2021.

The Director of Development Services has reviewed the proposed activity for compliance with the California Environmental Quality Act (CEQA) and has determined that the activity is not a “Project” as defined under Section 15378 of the State CEQA Guidelines because it will not result in a physical change in the environment; therefore, pursuant to Section 15060(c)(3) of the State CEQA Guidelines, the activity is not subject to CEQA.  Thus, no environmental review is required.

DISCUSSION

Pursuant to Public Resources Code (PRC) section 14581(a)(3)(A) of the California Beverage Container Recycling and Litter Reduction Act, the Department of Resources Recycling and Recovery (CalRecycle) is distributing $10,500,000 in fiscal year (FY) 2015‒16 to eligible cities and counties specifically for beverage container recycling and litter cleanup activities. The goal of CalRecycle’s beverage container recycling program is to reach and maintain an 80 percent recycling rate for all California Refund Value (CRV) beverage containers - aluminum, glass, plastic and bi-metal.

Staff is requesting Council approval to apply for this reoccurring, annual, cash payment program for a period of five years. These funds provide CRV collection, litter reduction containers and education at public access venues. Containers will be located in areas that currently lack recycling opportunities such as shopping corridors with pedestrian-friendly areas, public courtyards, recreation centers and libraries. Promotion of CRV container recycling opportunities will also be created using multi-media and printed media collateral materials. Funds will also be used to support litter clean-up events. 

DECISION-MAKER CONFLICT

Staff has reviewed the decision contemplated by this action and has determined that it is not site-specific and consequently, the 500-foot rule found in California Code of Regulations Title 2, section 18702.2(a)(11), is not applicable to this decision for purposes of determining a disqualifying real property-related financial conflict of interest under the Political Reform Act (Cal. Gov't Code § 87100, et seq.).

Staff is not independently aware, and has not been informed by any Council member, of any other fact that may constitute a basis for a decision maker conflict of interest in this matter.

 

LINK TO STRATEGIC GOALS

The Beverage Container Recycling City/County Payment Program supports the City’s Healthy Community goal by providing CRV container recycling opportunities and reducing litter, helping to keep Chula Vista Clean.

 

CURRENT YEAR FISCAL IMPACT

There is no current fiscal year impact to the General Fund. The Beverage Container Recycling City/County Payment Program is a cash payment program grant. Funds are received in advance and are appropriated through the budget process.

 

ONGOING FISCAL IMPACT

There will be no ongoing fiscal impact to the General Fund.
