SUMMARY

Pursuant to Chula Vista Municipal code 2.56.070 relating to contracts exceeding $100,000, City staff is requesting that City Council waive the competitive formal bid requirement and authorize staff to contract with GEOCAL, ITERIS, Merz Construction Company, South Bay Fence and Young Nicks Enterprises, Inc. for maintenance services for certain Public Works Projects

The Director of Development Services has reviewed the proposed project for compliance with the California Environmental Quality Act (CEQA) and has determined that the project qualifies for a Class 1 Categorical Exemption pursuant to Section 15301 (Existing Facilities) of the State CEQA Guidelines. Thus, no further environmental review is required.

DISCUSSION

Chula Vista Municipal Code Section 2.56.070(B)(3) permits the City Council to waive formal competitive bidding requirements when  the competitive bidding requirements as applied to that contract are impractical, impossible or that city interests would be materially better served by applying a different purchasing procedure approved by the purchasing agent as being consistent with good purchasing practices.  The Public Works Department is requesting that City Council waive the competitive formal bid requirement for GEOCAL, ITERIS, Merz Construction Company, South Bay Fence and Young-Nicks Enterprises, Inc.

 

GEOCAL performs several maintenance and replanting projects within Open Space Districts and Community Facility Districts (CFD). Many of the sites selected for these projects are within scenic corridors and highly visible areas. GEOCAL specializes in this type of maintenance work; have dedicated crews, complete projects in a timely manner, and provide a 90 day warranty for new plant installations areas. Additional maintenance tasks performed by GEOCAL within the Districts include:

 

                     Plant and shrub maintenance

                     Installing and spreading mulch

                     Brush Management

                     Fire clearance

 

GEOCAL has also performed maintenance work within City medians & parkways and proved to be efficient and priced lower than other vendors.

 

Beginning in 1999 the City began using video cameras and software for vehicle detection. Over the past 15+ years the city has engaged 3 to 4 different video detection system manufactures including ITERIS. ITERIS has proved to be a reliable manufacturer of video detection equipment and the most maintenance responsive. Furthermore, as original equipment becomes obsolete and/or fails replacement equipment is purchased from ITERIS at a 33% “survivor” discount.

 

The Construction & Repair (C&R) section of the Public Works Department seeks estimates from multiple vendors for Public Works building facility maintenance projects Merz Construction Company is consistently the lowest responsive bidder for building facility maintenance projects including:

 

                     Painting

                     Carpet maintenance

                     Restoration of doors

                     Replacement of damaged ceiling tiles

 

South Bay Fence is a local vendor used by multiple Public Works Department sections for maintenance of chain link fences and accessories and for maintenance of guardrails. Their bid proposals are continually the lowest responsive bid. South Bay Fence provides timely response to emergency needs such as enclosures necessary for public safety and fencing for securing construction sites.

 

Young-Nicks Enterprises, Inc. is contracted by the City of Chula Vista for storm drain channel clearing of invasive/exotic plants. They are knowledgeable in channel maintenance guidelines, mandates and environmental controls. They are experts in identifying and removing invasive plants without affecting native plants as well as effectively cleaning storm drain channels with minimum impact to the environment. Their consistency and reliability have been second to none and they continue to be the lowest-cost responsive contractor.

 

DECISION-MAKER CONFLICT

Staff has reviewed the decision contemplated by this action and has determined that it the work proposed to be done by Geocal, ITERIS, South Bay Fence and Young Nicks Enterprises, Inc. is not site-specific and consequently, the 500-foot rule found in California Code of Regulations Title 2, section 18702.2(a)(11), is not applicable to this decision for purposes of determining a disqualifying real property-related financial conflict of interest under the Political Reform Act (Cal. Gov't Code § 87100, et seq.).

 

With respect to the work proposed to be done by Merz Construction Company, staff has has reviewed the property holdings of the  City Council members and has found no property holdings within 500 feet of the boundaries of the property which is the subject of this action. Consequently, this item does not present a disqualifying real property-related financial conflict of interest under California Code of Regulations Title 2, section 18702.2(a)(11), for purposes of the Political Reform Act (Cal. Gov’t Code §87100,et seq.).

 

Staff is not independently aware, and has not been informed by any City Council member, of any other fact that may constitute a basis for a decision maker conflict of interest in this matter.

This action supports the Operational Excellence goal by retaining professional services from the lowest-cost responsive bids and the Strong and Secure Neighborhoods goal by preserving safe and well-maintained City infrastructure.

 

CURRENT YEAR FISCAL IMPACT

Approval of this resolution will authorize the City to receive services from GEOCAL, ITERIS, Merz Construction Company, South Bay Fence and Young-Nicks Enterprises, Inc. for Public Works projects. The costs are included within the Fiscal Year 2015-16 budget resulting in no additional fiscal impact.
