SUMMARY

Staff recommends that Council waive the competitive bid requirement and approve the agreement between California Product Stewardship Council (CPSC) and the City of Chula Vista.  CPSC has the unique expertise and performance capabilities to assist City staff in developing additional, convenient collection sites for household batteries and one-pound gas cylinders.

The Director of Development Services has reviewed the proposed project for compliance with the California Environmental Quality Act (CEQA) and has determined that the project qualifies for a Class 1 Categorical Exemption pursuant to Section 15301 (Existing Facilities) of the State CEQA Guidelines. Thus, no further environmental review is required.

DISCUSSION

The City of Chula Vista applied for a CalRecycle Grant to implement a new regional outreach program to encourage residents to recycle batteries and small gas cylinders at retail and community locations. CalRecycle awarded a $90,000 grant to the City and Council accepted the grant and appropriated the funds on August 18, 2015, (Resolution 2015-201).

 

Staff requests that Council waive the competitive bid requirement and approve the agreement with California Product Stewardship Council (CPSC) as CPSC was a partner on the original grant application which made the proposed project viable to CalRecycle.  CPSC has the expertise and performance capabilities to assist City staff in developing additional, convenient, collection sites for household batteries and one-pound gas cylinders due to their extensive knowledge, experience, and corporate relationship in Tehama, Mariposa, Santa Cruz, and San Benito counties and the cities of Oak Grove, Mountain View, Palo Alto and Sunnyvale, developing retail “take-back” collection sites for these products. CPSC has developed contacts and relationships with the retail sites (and their regional/corporate offices) where collection program collection containers will be established. Chula Vista is capitalizing on CPSC’s experience and expertise developed and utilized by these other jurisdictions to provide Chula Vista residents with additional, convenient drop-off locations in addition to the Household Hazardous Waste Drop-off Facility located at the City’s Public Works Yard, 1800 Maxwell Road, Chula Vista, 91911.

 

CPSC has prepared multiple multi-media promotional campaigns to encourage participation and proper disposal utilizing print, TV, radio, social and other media from their work with other jurisdictions which will be customized for Chula Vista. CPSC will collect data, perform site monitoring and prepare grant reports. 

 

 

DECISION-MAKER CONFLICT

Staff has reviewed the decision contemplated by this action and has determined that it is not site-specific and consequently, the 500-foot rule found in California Code of Regulations Title 2, section 18705.2(a) (11) is not applicable to this decision for the purpose of determining a disqualifying real property-related financial conflict of interest under the Political Reform Act (Cal. Gov’t Code § 87100, et seq.) Staff is not independently aware, and has not been informed by any Council member, of any other fact that may constitute a basis for a decision maker conflict of interest in this matter.

 

LINK TO STRATEGIC GOALS

The City’s Strategic Plan has five major goals: Operational Excellence, Economic Vitality, Healthy Community, Strong and Secure Neighborhoods and a Connected Community.  This Household Hazardous Waste Grant Program supports the City’s Healthy Community goal by providing additional, convenient, and appropriate recycling and disposal options for batteries and small gas cylinders in addition to the Household Hazardous Waste Drop-off Facility at the Public Works Yard.

CURRENT YEAR FISCAL IMPACT

Approval of this contract will have no current year fiscal impact to the General Fund as the $70,725 is funded by grants and the Environmental Services fund. All grant activities will be fully funded throughout the term of the Agreement and will not require General Fund appropriations.

 

ONGOING FISCAL IMPACT

There will be no on-going fiscal impact to the General Fund as a result of this work. Funding for this work will be covered by the Household Hazardous Waste Grant Program Fiscal Year 2015-16 and the Environmental Services fund.
