SUMMARY

In 2013, the California Public Employees' Retirement System (CalPERS) Office of Audit Services (OAS) conducted a public agency review for the City of Chula Vista to determine whether the City complied with applicable sections of the California Government Code, California Code of Regulations and its contract with CalPERS.

 

As a result of OAS's findings and recommendations, staff is submitting the revised Fiscal Year 2013-2014 Compensation Schedules effective August 9, 2013 and November 29, 2013 as required by California Code of Regulations (CCR), Title 2, Section 570.5.

 

ENVIRONMENTAL REVIEW

The activity is not a “Project” as defined under Section 15378 of the California Environmental Quality Act State Guidelines; therefore, pursuant to State Guidelines Section 15060(c)(3) no environmental review is required.

DISCUSSION

In 2013, the California Public Employees' Retirement System (CalPERS) Office of Audit Services (OAS) conducted a public agency review for the City of Chula Vista to determine whether the City complied with applicable sections of the California Government Code, California Code of Regulations and its contract with CalPERS.

 

As part of their review, OAS found that the City Council approved salary adjustments in accordance with the terms and conditions of a Memorandum of Understanding and the City Charter effective August 9, 2013 and November 29, 2013, respectively, but did not approve and adopt corresponding pay schedules ("Compensation Schedule") that met the requirements of the California Code of Regulations (CCR), Title 2, Section 570.5.  Specifically the Compensation Schedule must:

 

(1)                     Have been duly approved and adopted by the employer’s governing body in accordance with requirements of applicable public meetings laws;

(2)                     Identify the position title for every employee position;

(3)                     Show the pay rate for each identified position, which may be stated as a single amount or as multiple amounts within a range;

(4)                     Indicate the time base, including, but not limited to, whether the time base is hourly, daily, biweekly, monthly, bi-monthly, or annually;

(5)                     Be posted at the office of the employer or immediately accessible and available for public review from the employer during normal business hours or posted on the employer’s internet website;

(6)                     Indicate an effective date and date of any revisions;

(7)                     Be retained by the employer and available for public inspection for not less than five years; and

(8)                     Does not reference another document in lieu of disclosing the pay rate.

 

Following the CalPERS audit, staff immediately began submitting Compensation Schedules to reflect any across-the-board increases, classification changes and salary adjustments to the City Council for approval and adoption. However, as a result of OAS's findings and recommendations of the public agency review, staff is submitting the revised Fiscal Year 2013-2014 Compensation Schedules effective August 9, 2013 and November 29, 2013 pursuant to CCR, Title 2, Section 570.5.

 

DECISION-MAKER CONFLICT

Staff has determined that the action contemplated by this item is ministerial, secretarial, manual, or clerical in nature and, as such, does not require the City Council members to make or participate in making a governmental decision, pursuant to California Code of Regulations Title 2, section 18702.4(a). Consequently, this item does not present a conflict under the Political Reform Act (Cal. Gov't Code § 87100, et seq.). Staff is not independently aware, and has not been informed by any City Council member, of any other fact that may constitute a basis for a decision maker conflict of interest in this matter.

Approval of the revised Fiscal Year 2013-2014 Compensation Schedules effective August 9, 2013 and November 29, 2013 supports the City-wide strategic goal of Operational Excellence as it enhances disclosure and transparency of employee compensation and, as a result, fosters public trust through an open and ethical government.
