SUMMARY
The High Intensity Drug Trafficking Area (HIDTA) Director is requesting to add one Fiscal Agent (FA) Supervising Intelligence Analyst to its authorized staffing level. This position is fully reimbursed by grant funds, along with a 4% administrative fee for acting as the fiscal agent.
ENVIRONMENTAL REVIEW
The Development Services Director has reviewed the proposed activity for compliance with the California Environmental Quality Act (CEQA) and determined that the activity is not a “Project” as defined under Section 15378(b)(2) of the State CEQA Guidelines because it is a personnel relation action; therefore, pursuant to Section 15060(c)(3) of the State CEQA Guidelines, the activity is not subject to CEQA. Thus, no environmental review is necessary.

DISCUSSION
The Police Department acts as the fiscal agent for various law enforcement programs which are funded through various State and Federal agencies. As the fiscal agent, the Police Department hires and provides salary and benefits for positions which are normally considered separate from existing City staffing. These positions are designated as “FA” (Fiscal Agent) in the title description.
One FA Supervising Intelligence Analyst is requested to be added to the authorized count of the Police Grant Fund to support the San Diego Law Enforcement Coordination Center (SDLECC). The SDLECC serves as the regional intelligence fusion center for San Diego and Imperial counties. Fusion Centers are focal points for the receipt, analysis, gathering, and sharing of threat-related information between the federal government and state, local, tribal, and private sector partners. This new position is fully reimbursed by High Intensity Drug Trafficking Area (HIDTA) grant funds, along with a 4% administrative fee for acting as the fiscal agent.
The FA Supervising Intelligence Analyst will provide tactical and strategic intelligence services, products and investigative support to local, state and federal law enforcement agencies in efforts against all crimes associated with gangs, drug trafficking, and terrorism along California’s border with Mexico. This position includes supervisory responsibilities in the SDLECC Watch Center and/or Strategic Intelligence Unit. The FA Supervising Intelligence Analyst is an at-will position and dependent on federal grant funding.
DECISION-MAKER CONFLICT
Staff has determined that the action contemplated by this item is ministerial, secretarial, manual, or clerical in nature and, as such, does not require the City Council members to make or participate in making a governmental decision, pursuant to California Code of Regulations Title 2, section 18702.4(a). Consequently, this item does not present a conflict under the Political Reform Act (Cal. Gov't Code § 87100, et seq.). Staff is not independently aware, and has not been informed by any City Council member, of any other fact that may constitute a basis for a decision maker conflict of interest in this matter.

This new position supports the goal of Operational Excellence by providing additional resources to meet HIDTA goals and objectives.
CURRENT YEAR FISCAL IMPACT
Approval of this resolution will result in the addition of one FA Supervising Intelligence Analyst and a budget amendment of $120,628 to the personnel category of the Police Grant Fund. The personnel costs are fully reimbursed by HIDTA grant funds. The City receives a 4% administrative fee for acting as the fiscal intermediary for this position. Because of the 4% administrative fee, there is a positive impact of $4,825 to the General Fund in the current fiscal year.
ONGOING FISCAL IMPACT
The ongoing annual cost for this position is approximately $133,000. The personnel costs are fully reimbursed by HIDTA grant funds, and the City receives a 4% administrative fee for acting as the fiscal intermediary for this position. Because of the 4% administrative fee, there will be a positive impact of approximately $5,320 to the General Fund each fiscal year. If the HIDTA grant no longer funds this position, then it will be eliminated.
