SUMMARY

State and Federal regulations require the San Diego Association of Governments (SANDAG) to develop and adopt a Regional Transportation Improvement Program (RTIP) every two years in order to continue receiving Federal and State funding.  All the projects that the City of Chula Vista proposes to fund with TransNet funds must be included in the RTIP, as well as projects that are funded with Federal or State transportation funds.  Funding recommendations and signed resolutions must be submitted electronically to SANDAG by the June 3, 2016, deadline.

The activity is not a “Project” as defined under Section 15378 of the California Environmental Quality Act State Guidelines; therefore, pursuant to State Guidelines Section 15060(c)(3) no environmental review is required.

Environmental Determination

The Director of Development Services has reviewed the proposed activity for compliance with the California Environmental Quality Act (CEQA) and has determined that the activity is not a “Project” as defined under Section 15378 of the State CEQA Guidelines because the activity consists of governmental Regional Transportation Improvement Program/TransNet funds activity, which does not involve any commitment to any specific project that may result in a potentially significant physical impact on the environment. Therefore, pursuant to Section 15060(c)(3) of the State CEQA Guidelines, the activity is not subject to CEQA. Thus, no environmental review is required. Although environmental review is not required at this time, once the scope of potential individual projects has been defined, environmental review will be required for each project and the appropriate environmental determination will be made.

DISCUSSION

The purpose of this RTIP Amendment is to transfer available funds from some capital projects and reprogram funds to on-going projects that require additional funding.  Entries for the June Amendment to the 2014 RTIP can be made beginning April 22, 2016, and resolutions from the local agency must be received by SANDAG no later than June 3, 2016.  The SANDAG Board will ratify the amendment on July 22, 2016.

Transfers and Appropriations

This action is intended to reallocate funds allocated to Capital Improvement Program (CIP) projects that have been completed or can be completed within the existing budget but have available funds that can be reprogrammed.  These funds will be transferred to CIP projects that need additional funding and the transfers will be made between Maintenance projects in order to maintain the expenditure requirements in the TransNet Ordinance.  Since these funds have not yet been budgeted in the Capital Improvement Program, appropriation of these funds is required with this Council action.

Attachment 1 provides details of these transfers. 

Maintenance Projects

CHV33:  School Zone Traffic Calming (STL389 & TF345)

A fund transfer of $50,000 in TransNet funds is needed from STL389 to TF345.  No RTIP Amendment is needed for this action, since it does not change the CHV33 overall budget.  An appropriation is required to amend the CIP budget.

                     TF345:  The Traffic Calming Program requires $50,000 in order to provide sufficient funds to respond to public requests, coordinate with the Police Department, and prepare reports to the Safety Commission.

                     STL389:  The Castle Park Middle School Pedestrian Improvements project had partial funding as a local match share for a grant submittal that was not successful.  Staff will close out the project and rescope in a future CIP.  The remaining balance of $50,000 will be transferred to TF345.

                     $50,000 is proposed to be transferred to TF345 from STL389 to address the funding needs.

CHV45:  Traffic Monitoring Program (TF392, TF321, CHV34 for TF327)

A fund transfer of $88,000 is needed from TF392 to two CIP’s: TF321 & TF327.  A newly available less expensive traffic data collection system was implemented on Palomar Street, from Industrial Boulevard to Broadway, for $110,000 less than the original budget of $136,000.  Thus, $88,000 of the available balance will be moved to two projects.

No RTIP Amendment is needed for the $13,000 TransNet fund transfer to TF321, since it does not change the CHV45 overall budget.  An appropriation is required to amend the budget.

TF327 will require $75,000 in TransNet funds due to additional staff costs related to constituent requests and work related to Safety Commission investigations, report preparations and implementation. This action requires an RTIP Amendment since TF327 is in CHV34 and the funds are coming from CHV45.  An appropriation is also required to amend the CIP budget.

                     TF321:  The Citywide Traffic Count Program TF321 project requires $13,000.

                     TF327:  The Neighborhood Safety Program project requires $75,000.

                     TF392:  The Palomar Street Traffic Data Collection project is complete and $88,000 remain in the project.

                     $88,000 is proposed to be transferred from TF392 to TF321 and TF327 to address the funding needs.

CHV50:  Emergency Storm Drain and Bridge Culvert Repair (STM355 for GG222)

The City is in the process of selecting a consulting firm to prepare a Pedestrian Connectivity and Infrastructure Improvement Plan under GG222, Asset Management.  This consultant will conduct inspection and evaluation on all sidewalks and pedestrian ramps to access their condition and compliance with the Americans with Disabilities Act.  Recommendations for future CIP projects will also be provided.  Staff recommends appropriating an additional $70,000 to cover staff and consultant costs.  This project will be included under CHV34.

 

This action requires an RTIP Amendment since STM385 is in CHV50 and the funds are being transferred from CHV34.  An appropriation is required to amend the CIP budgets:

                     GG222:  The Asset Management project requires $70,000.

                     STM385:  The Emergency Storm Drain and Culvert Repair project is complete and $70,000 remain in the project.

                     $70,000 is proposed to be transferred to GG222 from STM385 to address the funding needs.

DECISION-MAKER CONFLICT

For STL389 and TF392

Staff has reviewed the property holdings of the City Council members and has found no property holdings within 500 feet of the boundaries of the property which is the subject of this action. Consequently, this item does not present a disqualifying real property-related financial conflict of interest under California Code of Regulations Title 2, section 18702.2(a)(11), for purposes of the Political Reform Act (Cal. Gov’t Code §87100,et seq.).

 

Staff is not independently aware, and has not been informed by any City Council member, of any other fact that may constitute a basis for a decision maker conflict of interest in this matter.

 

All Other Projects

Staff has reviewed the decision contemplated by this action and has determined that it is not site-specific and consequently, the 500-foot rule found in California Code of Regulations Title 2, section 18702.2(a)(11), is not applicable to this decision for purposes of determining a disqualifying real property-related financial conflict of interest under the Political Reform Act (Cal. Gov't Code § 87100, et seq.).

Staff is not independently aware, and has not been informed by any Council member, of any other fact that may constitute a basis for a decision maker conflict of interest in this matter.

LINK TO STRATEGIC GOALS

The City’s Strategic Plan has five major goals: Operational Excellence, Economic Vitality, Healthy Community, Strong and Secure Neighborhoods and a Connected Community.  The TransNet Local Street Improvement Program supports the Strong and Secure Neighborhood strategy in the City’s Strategic Plan.  It provides funding for the maintenance and rehabilitation of public infrastructure, which is a key City function in providing a safe and efficient transportation system for residents, businesses and visitors.

 

CURRENT YEAR FISCAL IMPACT

Approval of this resolution will result in the transfer of $50,000 from STL389 to TF345; $88,000 from TF392 to TF327 ($75,000) and TF321 ($13,000); and $70,000 from STM385 to GG222 in the TransNet funds.  There are sufficient funds in these projects to perform these appropriations.  Therefore, there are no additional impacts to the TransNet fund.

 

 ONGOING FISCAL IMPACT

Upon completion of the CIP projects, the improvements will require only routine maintenance.
