SUMMARY

The Fiscal Year 2016-17 Sewer Service Revenue Fund budget provides for the replacement of two 2005 Case backhoes.  The City of Chula Vista Municipal Code Section 2.56.270 and Council Resolution No. 6132 authorize the Purchasing Agent to participate in cooperative bids with other government agencies for the purchase of materials of common usage.  The City has an opportunity to participate in a current National Joint Powers Association (NJPA) contract for such equipment.

The activity is not a “Project” as defined under Section 15378 of the California Environmental Quality Act State Guidelines; therefore, pursuant to State Guidelines Section 15060(c)(3) no environmental review is required.

The Director of Development Services has reviewed the proposed activity for compliance with the California Environmental Quality Act (CEQA) and has determined that the activity is not a “Project” as defined under Section 15378 of the State CEQA Guidelines because it will not result in a physical change in the environment; therefore, pursuant to Section 15060(c)(3) of the State CEQA Guidelines, the activity is not subject to CEQA.  Thus, no environmental review is required.

DISCUSSION

The Fiscal Year 2016-17 Sewer Service Revenue Fund budget provides for the replacement of two 2005 Case backhoes.  Due to the unique nature of this equipment, Wastewater Maintenance staff researched the types of equipment available in the industry, and evaluated each prospective piece of equipment for its functionality and suitability for its intended purpose.  The City fleet currently has three such Case make backhoes, which have had exceptional performance and reliability records through many years of operation.  Additionally, productivity will be enhanced by acquiring equipment whose operating control features are very familiar to wastewater maintenance  staff and equipment mechanics.   A current MJPA contract for such machines meeting the needs of the City exists.

 

Replacing the existing backhoes at this time will yield improvements in the ability of the Wastewater Maintenance program to maintain the City’s assets that are represented by sewer lines, and will lead to lower costs of maintaining such assets in the immediate future, and to extend the useful life of these assets.

 

DECISION-MAKER CONFLICT

Staff has reviewed the decision contemplated by this action and has determined that it is not site specific and consequently, the 500-foot rule found in California Code of Regulations section 18704.2(a)(1), is not applicable to this decision. Staff is not independently aware, and has not been informed by any City of Chula Vista City Council member, of any other fact that may constitute a basis for a decision maker conflict of interest in this matter.

 

LINK TO STRATEGIC GOALS

The City’s Strategic Plan has five major goals: Operational Excellence, Economic Vitality, Healthy Community, Strong and Secure Neighborhoods and a Connected Community. This action supports the goal of providing Healthy Communities, as having service vehicles in good working condition meeting the current emission control standards allowing staff to maintain and operate community and neighborhood wastewater facilities.

 

CURRENT YEAR FISCAL IMPACT

The net total cost including taxes and fees is $250,886. Sufficient funds have been budgeted in the FY2016-17 budget. There is no net fiscal impact to the General Fund approving this resolution.

 

ONGOING FISCAL IMPACT

Since this is a replacement for existing aging equipment, maintenance costs are included in the current fiscal year budget, resulting in no additional ongoing fiscal impact.
