SUMMARY

Pursuant to Chula Vista Municipal Code 2.56.070 relating to contracts exceeding $100,000, the Police Department is requesting to waive the competitive formal bid requirement and authorize to purchase ammunition, bulletproof vests and equipment from San Diego Police Equipment Company.

The Director of Development Services has reviewed the proposed activity for compliance with the California Environmental Quality Act (CEQA) and has determined that the activity is not a “Project” as defined under Section 15378 of the State CEQA Guidelines because it will not result in a physical change in the environment; therefore, pursuant to Section 15060(c)(3) of the State CEQA Guidelines, the activity is not subject to CEQA.  Thus, no environmental review is required.

DISCUSSION

San Diego Police Equipment Company provides the Police Department with ammunition, bulletproof vests and essential police equipment to support the daily operations of sworn personnel. In fiscal year 2016, the Police Department spent $91,600. Cumulatively, over the past three years the total costs from this vendor have exceeded the $100,000 spending threshold per the City’s purchasing policies.  City staff has researched other vendors that can provide the same type of equipment or ammunition and have determined that although other vendors can provide similar products, the shipping costs alone (in particular for ammunition shipping) make it cost prohibitive to work with vendors that are outside of the County. San Diego Police Equipment Company is currently the only local vendor that can supply the Police Department ammunition that can be picked up by the Department and therefore save the City the cost to transport it. Additionally, the City recently awarded San Diego Police Equipment Company the contract to supply the Police Department with bulletproof vests. The costs for these vests will also add to the total costs paid to the vendor and the overall aggregate amount that is governed by Chula Vista Municipal Code 2.56.070.  Chula Vista Municipal Code Section 2.56.070(B)(4) permits the City Council to waive formal competitive bidding requirements when a commodity or services is available from only one known source as the result of unique performance capabilities and manufacturing processes, which is the case with San Diego Police Equipment Company.

 

DECISION-MAKER CONFLICT

Staff has reviewed the decision contemplated by this action and has determined that it is not site specific and consequently the 500-foot rule found in California Code of Regulations section 18704.2(a)(1) is not applicable to this decision.  Staff is not independently aware, nor has staff been informed by any City Councilmember, of any other fact that may constitute a basis for a decision maker conflict of interest in this matter.

The City’s Strategic Plan has five major goals: Operational Excellence, Economic Vitality, Healthy Community, Strong and Secure Neighborhoods and a Connected Community.  The purchase of ammunition, bulletproof vests and essential police equipment supports the goal of Strong and Secure Neighborhoods by equipping public safety personnel with necessary resources to provide a safe community.

 

CURRENT YEAR FISCAL IMPACT

Approval of this resolution will authorize the Police Department to purchase ammunition, bulletproof vests and police equipment from San Diego Police Equipment Company.  These costs are already included in the department’s budget, resulting in no additional fiscal impact to the General Fund.

 

ONGOING FISCAL IMPACT

There is no ongoing fiscal impact.
