The Police Department is requesting an appropriation of $45,000 from the available balance of the Inmate Welfare Fund for personnel costs of a Life Enrichment Coordinator, fitness and recreation equipment for jail inmates and installation of television enclosures at the city jail.

DISCUSSION

Under California Penal Code Section 4025, an Inmate Welfare Fund is mandated to provide services essential to the benefit, welfare and educational needs of the inmates confined in the detention facilities.  The money deposited into the Inmate Welfare Fund includes commission attributable to the use of pay telephones that are primarily used by inmates while incarcerated, along with sales from the jail commissary.  The jail commissary allows inmates to purchase supplies necessary for their comfort, sanitation and welfare.  Such supplies are candy, snacks, writing materials and hygiene items.

 

Inmate welfare funds may not be used to pay for required expenses of confining inmates in a local detention system, such as meals, clothing, housing or medical services.  The City has established an interest-bearing fund outside the General Fund for the Inmate Welfare Fund.  The Police Department is requesting an appropriation of $45,000 from the available balance of the Inmate Welfare Fund for personnel costs of a Life Enrichment Coordinator, fitness and recreation equipment for jail inmates and installation of television enclosures at the city jail.  The Life Enrichment Coordinator is an hourly employee from the Recreation Department, who will lead recreational activities (such as exercise/fitness classes) to inmates at the city jail.

 

DECISION-MAKER CONFLICT

Staff has reviewed the decision contemplated by this action and has determined that it is not site-specific and consequently, the 500-foot rule found in California Code of Regulations Title 2, section 18702.2(a)(11), is not applicable to this decision for purposes of determining a disqualifying real property-related financial conflict of interest under the Political Reform Act (Cal. Gov't Code § 87100, et seq.).

 

Staff is not independently aware, and has not been informed by any Council member, of any other fact that may constitute a basis for a decision maker conflict of interest in this matter.

 

LINK TO STRATEGIC GOALS

The City’s Strategic Plan has five major goals: Operational Excellence, Economic Vitality, Healthy Community, Strong and Secure Neighborhoods and a Connected Community.  The appropriation to the Inmate Welfare Fund supports the goal of Operational Excellence by providing appropriate resources to inmates at the city jail.

 

CURRENT YEAR FISCAL IMPACT

Approval of this resolution will result in a one-time appropriation of $15,000 to the personnel category and $30,000 to the supplies and services category of the Inmate Welfare Fund.  There is no fiscal impact to the General Fund.

 

ONGOING FISCAL IMPACT

There is no ongoing fiscal impact for approving this one-time appropriation.
