SUMMARY

In anticipation of the expiration of the agreement with Ace Parking, the City issued a request for proposal for parking management and enforcement services for the Downtown Parking District. Two bidders submitted proposals. After an evaluation, a selection committee recommended Ace Parking. In this action, staff recommends approval of a 16 month agreement with Ace Parking with up to three (3) one-year renewal options.  Staff also recommends an appropriation to the Parking Meter Fund to reflect updated contract costs.

The Director of Development Services has reviewed the proposed activity for compliance with the California Environmental Quality Act (CEQA) and has determined that the activity is not a “Project” as defined under Section 15378 of the State CEQA Guidelines because it will not result in a physical change in the environment; therefore, pursuant to Section 15060(c)(3) of the State CEQA Guidelines, the activity is not subject to CEQA.  Thus, no environmental review is required.

DISCUSSION

Chula Vista Municipal Code Section 10.62.010.B authorizes the City to contract with a duly qualified company approved by the Chief of Police to provide enforcement of infraction violations of specified chapters of the Chula Vista Municipal Code:  10.52, stopping, standing and parking; 10.56, parking meters, parking meter zones and permit parking; and 10.60, loading zones. The City has contracted for parking management and enforcement services in the Downtown Parking District since 2009.  The City Council awarded Ace Parking the initial contract for parking management and enforcement services in the District in 2009, and Ace Parking has provided these services since. The Downtown Parking District is the only parking district in which the City contracts for parking enforcement. The Downtown Parking District is bordered by E Street, Del Mar Avenue, H Street and Garrett Avenue. It provides more than 1,700 parking spaces through surface parking lots, street metered spaces, and a parking structure.  

 

In anticipation of the expiration of the agreement with Ace Parking, the City issued a request for proposal (RFP) for parking management and enforcement services in the Downtown Parking District in 2015. Ace Parking and Joe’s Auto Parks submitted proposals in response to the RFP. A committee evaluated the proposals and interviewed representatives from Ace Parking and Joe’s Auto Parks.  The committee recommended the selection of Ace Parking. Chief of Police Roxana Kennedy has approved the recommendation.

 

Staff is recommending that the City enter into an agreement of 16 months with Ace Parking with up to three (3) one-year renewal options for a total of 52 months.  The following table reflects the anticipated yearly expenses for parking management and enforcement services in the Downtown Parking District as proposed by Ace Parking:

Staff is also recommending an appropriation to the Parking Meter Fund to reflect the updated contract costs. It is anticipated that the revenues generated in the Downtown Parking District are sufficient to cover the expense of the contract. 

 

DECISION-MAKER CONFLICT

Staff has reviewed the property holdings of the City Council and has found that, Mayor Salas has real property holdings within 500 feet of the boundaries of the property which is the subject of this action. Consequently, pursuant to California Code of Regulations Title 2, sections 18700 and 18702.2(a)(11), this item presents a disqualifying real property-related financial conflict of interest under the Political Reform Act (Cal. Gov't Code § 87100, et seq.) for the above-identified member.

 

Staff is not independently aware, and has not been informed by any City Council member, of any other fact that may constitute a basis for a decision maker conflict of interest in this matter.

 

 

LINK TO STRATEGIC GOALS

The agreement with Ace Parking supports the goal of Operational Excellence - Uphold a commitment to Fiscal Health.  Through the competitive bid process the City is working to ensure the best use of available resources.

 

CURRENT YEAR FISCAL IMPACT

Revenues and expenditures related to the Downtown Parking District are accounted for in the Parking Meter Fund.  The fiscal year 2017 budget does not reflect the new contract amount; an additional appropriation of $50,000 for the current year is recommended.  The appropriation will be made from the available balance of the Parking Meter Fund. It is anticipated that revenues generated in the Downtown Parking District will be sufficient to offset the expenses related to the Ace Parking agreement.  

       

ONGOING FISCAL IMPACT

The Ace Parking agreement includes an annual increase to the parking management budget.  The Parking Meter Fund budget will be adjusted accordingly and these changes will be considered by the City Council as part of the normal annual budget process. 

 

It is anticipated that revenues generated in the Downtown Parking District will continue to be sufficient to cover the expenses related to the Ace Parking agreement.
